Collinge & Co's ("Collinge & Co" "we" "us") website collingeandco.com (our "Website") and related services are made available to you in accordance with the following Terms and Conditions, and any other rules posted on our Website (collectively, the "Terms").

Please read these carefully before you start to use our website, as these will apply to your use of our website and will apply to sales when purchasing goods from our Website.

By using our Website, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our Website.

We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our Website.

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms, and that they comply with them.

Your Eligibility to Purchase

To make purchases on the Website, you will be required to provide your personal details: name, phone number, e-mail address, billing address, delivery address, credit-card details and other information requested during the checkout process. The details you supply must be true, accurate and complete. You must not be impersonating any other individual by the information you supply.

The information you provide will be used by us, third-party contractors employed by us and their sub-contractors to authenticate your identity, validate your debit/credit card, authorise payment and communicate with you with regards to providing services in relation to your purchase. You give us permission to transmit information to, or to obtain information about you, from third parties for these purposes.

Orders are only accepted for UK delivery addresses.

Your Privacy

We take the privacy of your information very seriously and we take suitable steps to protect your data and comply with the UK's Information Commissioner's Office. We will never provide your details to a third party. We will never sell our customer data to a third party.

Mobile Terms of Service

The Collinge & Co mobile message service (the "Service") is operated by Collinge & Co (Holdings) Limited (“Collinge & Co”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Collinge & Co’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Collinge & Co through your wireless provider to the mobile number you provided, even if your mobile number is registered on any Do Not Call list. Text messages may be sent using an automatic telephone dialling system or other technology. Service-related messages may include updates, alerts, and information (e.g. order updates, account alerts, etc). Promotional messages may include promotions, specials, and other marketing offers (e.g. cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with us. Your participation in this program is completely voluntary. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Collinge & Co mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Pricing

Prices shown on this Website are in GBP, and are inclusive of VAT at the 20% rate, where applicable

All prices and offers remain valid as advertised from time to time. The GBP price of a product displayed on the Website at the time the order is accepted will be honoured, except in cases where we have identified an error in the price.

Orders and Stock Availability

Collinge & Co only offers products for sale that are in stock and available for despatch, however, items in your shopping basket are not reserved and may be purchased by other customers. All orders are subject to acceptance and availability. Payment is required in full for an order to be placed.

Acceptance of Orders

Once you have made payment and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, only a confirmation that we have received it.

Our acceptance of your order will take place when we email you to accept it and confirm despatch of your order, at which point a contract will come into existence between you and us. Our third-party payment processor and courier do not have the authority to accept an order on behalf of Collinge & Co.

We reserve the right not to accept your order in the event, but not exclusive to: authorisation for payment cannot be obtained, shipping restrictions, that an item is out-of-stock, is withdrawn from sale due to quality control, or purchase eligibility has not been met as described in the Terms above.

We may also refuse to accept an order for any reason at our discretion. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that an order is refused whilst in transit, we will process your refund once the products have been returned to us.

Payments

We accept card payment by Visa, Mastercard, Maestro and American Express. You confirm that the credit/debit card that is being used is yours or that the owner of the credit/debit card specifically authorised you to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable to you for any delay or non-delivery.

Promotional Codes

There is no cash alternative to promotional codes and they are not transferable. Promotional codes cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the published expiry date, if provided.

Gift Card

Gift Cards sold through this Website can only be redeemed in Collinge & Co salons. They cannot be used to purchase products on this Website. They are non-transferable, may not be returned and cannot be redeemed for cash.

Collinge & Co Gift Cards are digital and their sale, use and balance is recorded on the salon point-of-sale software. Digital Gift Cards are sent via email. Digital Gift Cards have an expiry date 1000 days from the purchase date,

Collinge & Co Gift Cards can be redeemed against all services and products sold in Collinge & Co salons. If your order total is less than the value of the Gift Vouchers used the remaining balance will be recorded for future use.

If you return products bought in the salon using Gift Cards, then the refund will be made onto a digital card.

Paper Gift Vouchers: Collinge & Co paper gift vouchers were last sold in July 2020. Collinge & Co paper gift vouchers can still be redeemed in Collinge & Co salons. If your order total is less than the value of the Gift Vouchers used, no change will be given, but the balance transferred onto a digital card.

Redeeming Website Offers

Website offers will be advertised with a coupon code. The coupon code can be entered at the checkout – at top of the page where billing details are completed.

Offer adverts may specify limitations on redeeming the offer such as: expiry dates, the frequency a coupon can be used per email/person, a minimum or maximum spend, a limitation to redeem the offer against certain products or services, restrictions against redeeming the offer in conjunction with other offers or sales.

Offers can only be redeemed at the point of sale and cannot be redeemed retrospectively. It is the buyer's responsibility to enter any valid coupon codes they hold at the collingeandco.com Checkout.

Security

We take reasonable care to make our Website secure. All credit/debit card transactions on this Website are processed using Stripe, a secure online payment gateway that encrypts your card details in a secure host environment. We do not store your credit/debit card details on our own systems. Secure Socket Layer (SSL) technology is used for added security and safety.

In addition, we take reasonable care wherever we have the power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

It is your responsibility to protect your password used for collingeandco.com from being disclosed to any third party.

Transfer of Ownership

You will own the goods on and from the point in time when we deliver the goods to you.

We require a signature for any goods delivered, at which point, responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift), then you accept that evidence of a signature by them (or at that delivery address), is evidence of delivery and fulfilment by Collinge & Co, and transfer of responsibility. The goods are your responsibility once we deliver them to the address you gave us.

Delivery

Free 2-4 day delivery on orders over £25. Orders under £25 will have a £3.95 delivery charge.

We aim to dispatch all orders placed before 3pm on the same day (Monday to Friday; excluding bank holidays). Product orders placed after 3pm will be dispatched the next working business day. Orders placed after 3pm on a Friday, Saturdays, or Sundays, will be dispatched on a Monday.

Delivery is to the UK only.

Orders delivered to Northern Ireland, Scottish Highlands and UK islands will have a longer delivery time.

If you believe your order is delayed please contact us via email to orders@collingeandco.com and we will be able to provide an update from the courier.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will make effort to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received.

If you would like to order from outside the UK, please contact us and we can consider your delivery on a case-by-case basis. Please note that aerosols cannot be shipped by air and restricts where they can be sent.

Digital Gift Cards

Gift Cards are sent digitally via email. There is no physical delivery by post.

Returns, Cancellations and Exchanges

We hope you are happy with your purchases, however if you want to return an order, for whatever reason, please refer to our Returns Policy on how to do so.

All orders delivered to addresses in the EU are protected under the Consumer Contracts Regulations. You have the right to cancel an order without providing a reason. Please refer to the Returns policy for a description on how to cancel an order under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Our Returns Policy does not affect your statutory rights.

Refunds

Refunds will be made via the original payment method.

Intellectual Property

The use of our Website is for your personal, non-commercial use only. The use of the Website grants you no rights in relation to the contents, including: copyright, imagery, music, video, text, design, code, trademarks and all other intellectual property, including that of third-parties. The content may not be modified, copied or distributed without express permission from Collinge & Co (Holdings) Limited. Reproduction or distribution of the above listed prohibited material could result in civil or criminal penalties. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.

This Website may include links to other websites that may be of interest to you. We do not endorse or approve, and have no liability or responsibility for the content of any website to which the Website links to, including but not limited to: any advertising, marketing, promotions, products or services available from such websites, nor for any loss caused by the use of or reliance on the content of such external websites.

Under the Law of England and Wales you have certain rights, including us:

  • supplying products ordered from this Website that are of satisfactory quality, perform their intended purpose, and match their description as on this Website.
  • producing a satisfactory resolution if you are in the receipt of a faulty product ordered from this website.

Limits on Liability

Nothing in these Terms shall affect your rights as a consumer or exclude our liability for personal injury or death caused by our negligence.

We are not responsible for loss or damage not caused by our breach or negligence, or any loss which was not reasonably foreseeable by you or us.

Amendments

We reserve the right to update these Terms from time-to-time, without notice. The new Terms will come into effect immediately from the time they are published to the Website. It is your responsibility to check for changes and your use of the Website indicates your willingness to be bound by the Terms.

Waiver

If the Terms are breached, and no action is taken by either us or you, this shall not constitute a waiver towards any proceeding or future breach of the Terms.
